TERMS & CONDITIONS

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY.

The One Country Daily Email, Web site (the "Daily Email," "Web Site" or "OneCountry.com") is provided by Acumen Brands, Inc. ("One Country") and/or its affiliates and subsidiaries for your and others' personal, non-commercial enjoyment, subject to the terms of these terms and conditions of use and all modifications thereto (collectively, the "Terms and Conditions"), and the rules that may be published from time to time by One Country. By using the daily email or site, you are deemed to have agreed to these terms and conditions of use. One Country may change the Terms and Conditions from time to time and at any time, and without notice to you. All such changes to these Terms and Conditions will appear on OneCountry.com. By using the daily email or site after we post any changes, you agree to accept those changes, whether or not you have reviewed them. If at any time you choose not to accept these Terms and Conditions of Use, please do not use the daily email or site.

User Conduct

The Daily Email and Web Site and any communications service, including the capability to contribute material through the contribution form (each such submission, a "Contribution"), chat room, message board, newsgroup, or other interactive service that may be available to you on or through the daily email and site (collectively, the "Services") are provided to you solely for entertainment and informational purposes. By using the Daily Email, Web Site and Services you agree: (a) to provide true, accurate, current and complete information about yourself as prompted by the subscription form, the Contribution form and any registration form(s). If any information provided by you is untrue, inaccurate, not current or incomplete, One Country reserves the right to terminate your subscription and refuse any and all current or future use by you of the Services.

Without limitation of the foregoing, you agree to not use the Daily Email, Web Site or Services to:

  • Upload, post, publish, e-mail, reproduce, distribute or otherwise transmit any information, data, text, music, sound, photographs, graphics, video, messages or other materials, including any Contribution, (collectively, "Content"), that is unlawful, harmful, threatening, embarrassing, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, deceptive, fraudulent, contains explicit or graphic descriptions or accounts of sexual acts, invasive of another's privacy, or hateful;
  • "Stalk" another;
  • Upload, post, publish, e-mail, reproduce, distribute or otherwise transmit any Content that victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
  • Harm minors in any way;
  • Impersonate any person or entity, including, but not limited to, a One Country official, or falsely state or otherwise misrepresent your affiliation with a person or entity;
  • Forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted to or through the Daily Email or Web Site;
  • Upload, post, publish, e-mail, reproduce, distribute or otherwise transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
  • Upload, post, publish, e-mail, reproduce, distribute or otherwise transmit any Content that infringes any patent, trademark, trade secret, copyright or other proprietary or confidentiality rights of any party;
  • Upload, post, publish, e-mail, reproduce, distribute or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "Spam," "chain letters," "pyramid schemes," or any other form of solicitation;
  • Upload, post, publish, e-mail, reproduce, distribute or otherwise transmit any material that contains software viruses, Trojan horses, worms, time bombs, cancel bots, or any other computer code, files or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment or any other similarly destructive activity, or surreptitiously intercept or expropriate any system, data or personal information;
  • Act in a manner that negatively affects other users' ability to engage in the Daily Email, Web Site or Services;
  • Engage in any activity that is contrary to or which would adversely affect the purpose or intention of the Daily Email, Web Site or Services, including but not limited to, actually or attempting to manipulate, corrupt or otherwise affect the outcome of the Services, in whole or part, by, among other methods, subscribing another party without their authorization or registering multiple subscriptions under the same or different names;
  • Interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service; or
  • Intentionally or unintentionally violate any applicable local, state, national or international law.

You also agree that you will not harvest, collect or store information about the users of the Daily Email, Web Site or the Content posted by others on the Daily Email, Web Site or use such information for any purpose inconsistent with the purpose of the Daily Email, Web Site or for the purpose of transmitting or facilitating transmission of unsolicited bulk electronic mail or communications.

You acknowledge that One Country is not responsible for material submitted to One Country or posted to the Daily Email or Web Site by users. One Country does not pre-screen, monitor, review or edit the Content posted by users. However, One Country and its designees have the right (but not the obligation) at their sole discretion to refuse or remove any Content, in whole or part, that, in One Country's judgment, does not comply with these Terms and Conditions or is otherwise undesirable, inappropriate or inaccurate. One Country is not responsible for any failure, non-failure or delay in removing such Content. You will remain responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of such submitted material, including any Contribution or part thereof, or other communication to One Country. You agree to immediately notify One Country of any unauthorized use of the Service or any other breach of security known or suspected by you.

You acknowledge and agree that One Country may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce these Terms and Conditions; (c) respond to claims that any Content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of One Country, its users or the public.

You understand that the technical processing and transmission of the Daily Email and Web Site, including your Content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. One Country assumes no responsibility for the deletion, alteration or failure to store postings, Contributions or other information submitted by you or other users to the Daily Email or Web site.

Any or all Content on the Daily Email and Web Site may be purged periodically in One Country's sole discretion. You acknowledge and agree that Content you view, submit or post is at your own discretion and risk, including any reliance on the accuracy, completeness, or usefulness of such Content. You acknowledge that you may not rely on any information, data, text, music, sound, photographs, graphics, video, messages or other materials created by One Country or submitted to One Country, including Content. You further acknowledge and agree that the views expressed on the Daily Email and Web Site do not necessarily reflect the views of One Country, and One Country does not support or endorse Content (including any Contribution, whether or not edited by One Country or its designee or presented on the Daily Email or Web Site edited or unedited, in whole or in part, or alone or with other content) posted or submitted by you or any User.

Upload, post, publish, e-mail, reproduce, distribute or otherwise transmit any information, data, text, music, sound, photographs, graphics, video, messages or other materials, including any Contribution, (collectively, "Content"), that is unlawful, harmful, threatening, embarrassing, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, deceptive, fraudulent, contains explicit or graphic descriptions or accounts of sexual acts, invasive of another's privacy, or hateful;

Mobile / Wireless Policy

In addition to any fee of which you are notified, your provider's standard messaging rates apply to our confirmation and all subsequent SMS correspondence. No more than two messages per day per SMS subscription will be sent. All mobile and wireless charges applicable to your use of the Web Site or the Services are billed by and payable to your mobile service provider.

We will not be liable for any delays in the receipt of any SMS messages, as delivery is subject to effective transmission from your network operator. SMS message services are provided on an AS IS basis.

Data obtained from you in connection with this SMS service may include your cell phone number, your provider's name, and the date, time, and content of your messages. We may use this information to contact you and to provide the services you request from us. We will never share this information with a third party.

Restrictions On Use of Material

The content on the Daily Email and Web Site is intended for entertainment and informational purposes only. Except as expressly permitted, you agree not to use the Daily Email or Web Site for sale, trade or other commercial purposes, and, you may not modify, copy, publish, display, transmit, adapt or in any way exploit the content of the Daily Email or Web Site. Only if you obtain prior written consent from us -- and from all other entities with an interest in the relevant intellectual property -- may you publish, display or commercially exploit any material from the Daily Email or Web Site. To seek our permission, you may write to us at our address provided below. If permission is granted by us and by all other entities with an interest in the relevant intellectual property, you may not change or delete any author attribution, trademark, legend or copyright notice.

You must abide by all additional copyright notices or other restrictions contained on the Daily Email or Web Site.

Unsolicited Materials

In operating the daily email and site, One Country does not solicit nor does it wish to receive any confidential, secret or proprietary information or other material from you through the Daily Email or Web Site or One Country mail and e-mail addresses, or in any other way. Any information or material submitted or sent to One Country, will be deemed not to be confidential or secret. By submitting or sending information or other material to One Country you represent and warrant that the information is original to you and that no other party has any rights to the material.

User's Grant Of Limited License

By communicating with One Country, including submitting or sending Content, a Contribution or other information or material to the Daily Email or Web Site, you grant One Country the royalty-free, unrestricted, world-wide, perpetual, irrevocable, non-exclusive and fully sub-licensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such Content (in whole or part), including any information, suggestions, ideas, drawings or concepts contained in such Content, worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed. Such license includes incorporating a Contribution, in whole or in part, into a One Country feature. You will remain responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of such submitted material, including any Contribution or part thereof, or other communication to One Country.

You also warrant that any "moral rights" in posted materials have been waived.

Linked Sites

You may be able to link to third parties' Web Sites ("Linked Sites") from the Daily Email or Web Site. Linked Sites are not, however, reviewed, controlled, or examined by One Country in any way and One Country is not responsible for the content, availability, advertising, products or other materials of any such Linked Sites, or any additional links contained therein. These links do not imply One Country's endorsement of or association with the Linked Sites. It is your sole responsibility to comply with the appropriate terms of service of the Linked Sites as well as with any other obligation under copyright, secrecy, defamation, decency, privacy, security and export laws related to the use of such Linked Sites and any content contained thereon. In no event shall One Country be liable, directly or indirectly, to anyone for any loss or damage arising from or occasioned by the creation or use of the Linked Sites or the information or material accessed-through these Linked Sites. Contests, Promotions, Simulations or Games

From time to time, One Country may offer as part of the Services, either on or through the Daily Email, Social Media and the Web Site, contests, promotions, simulations or games (collectively, "Games"). To participate in Games, players may be required to complete a registration form. Upon submission, all registrations become the exclusive property of One Country. Registered users (each, a "Registered User") are permitted only one entry. Registered Users with more than one entry are subject to immediate disqualification from any Game, unless the description of the Game expressly invites a user to register multiple times. One Country, at its sole discretion, may suspend or revoke the registration of any Registered User.

Registered Users agree to release One Country and its agents, advertisers, sponsors or promotional partners, from all liability arising from participation in any of Game located on, or accessed through, the Daily Email, Social Media or Web Site. One Country is not responsible for technical, hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmissions which may limit any Registered User's ability to participate in any Game.

Each Registered User agrees to be bound by the rules of any Game and by the rules of fair play and consideration of fellow Registered User. A Registered User who violates any of the rules or guidelines for behavior published on the Daily Email, Social Media or Web Site, or the site where the Game is conducted, are subject to immediate disqualification and revocation of their registration. One Country is under no obligation to award any prize to any Registered User who violates a published rule or guideline.

Some Games may offer prizes to Registered Users. All prizes are subject to the official game or contest rules published with that Game.

One Country reserves the right to cancel, terminate or alter any Game or the rules thereof at any time without prior notification.

Intellectual Property Rights

All materials contained in the Daily Email and Web Site are the copyrighted property of One Country and its affiliates or licensors. As between One Country and you, One Country is the sole owner of all content on the Daily Email and Web Site, including without limitation, all applicable U.S. and non-U.S. copyrights, patents, trademarks, and trade secrets, and other intellectual property rights thereto. Except as otherwise specifically provided in these Terms and Conditions, you may not download or save a copy of the Daily Email or Web Site or any portion thereof, for any purpose. You may, however, print a copy of individual screens appearing as part of the Daily Email or Web Site solely for your personal, non-commercial use or records, provided that any marks, logos or other legends that appear on the copied screens remain on, and are not removed from the printed or stored images of such screens. All title and intellectual property rights in and to the content of the Linked Sites is the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties.

Parental Permission

The Daily Email and Web Site are not intended to be a children's site, therefore, some of the available information may concern topics that may not be appropriate for children. One Country may, at its discretion, require users under 18 to obtain the consent of a parent or guardian to view certain content, and One Country may limit access to certain content to users above a specified age. You agree to abide by any such restrictions, and not to help anyone avoid those restrictions.

Editorial

One Country items are selected by our editors. No one can pay to be featured on One Country. That's what advertising is for, and it's always labeled as such. Selling ourselves (literally) would destroy the legitimacy, integrity, and fun of One Country. Plus, we'd never earn your trust that way. That said, on occasion, we will send out "advertorial" e-mails on behalf of sponsors. You'll recognize them from the subject line, which will indicate that the email is advertorial. Advertorial emails are paid for. When you sign up for One Country you are agreeing not only to get our content delivered to you free, but also to occasionally receive one of these advertorial e-mails from our sponsors. If you would prefer not to get these e-mails, just unsubscribe from all editions of One Country (unfortunately you won't be getting -any- One Country e-mails any more).

One Country reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with One Country in asserting any available defense.

Copyrights and Copyright Agent

We respect the intellectual property rights of others, and require that the people who use the One Country Daily Email and Web Site do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, please forward the following information to the Copyright Agent named below:

Your username, address, telephone number, and e-mail address;

A description of the copyrighted work that you claim has been infringed;

A description of where the alleged infringing material is located;

A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;

An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; and

A statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Applicable Laws / Jurisdiction

You agree that the laws of the State of Arkansas, excluding its conflicts-of-law rules, shall govern these Terms and Conditions. Please note that your use of the Daily Email and Web Site may be subject to other local, state, national, and international laws. You expressly agree that exclusive jurisdiction for any claim or dispute with One Country or relating in any way to your use of the Daily Email and Web Site resides in the courts of the State of Arkansas , and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the State of Arkansas , in connection with any such dispute and including any claim involving One Country or its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers and content providers.

We control and operate the daily email and site from our offices in Fayetteville, Arkansas. We do not represent that materials on the daily email and site are appropriate or available for use outside of Fayetteville, Arkansas. Persons who choose to access the daily email and site from other locations do so on their own initiative, and are responsible for compliance with local laws, if and to the extent local laws are applicable.

Provisions Unenforceable or Invalid

Assignment

You shall not transfer, assign, sublicense nor pledge in any manner whatsoever, any of your rights or obligations under this Agreement. One Country may transfer, assign sublicense or pledge in any manner whatsoever, any of its rights and obligations under this agreement to a subsidiary, affiliate, or successor thereof or to any third party whatsoever, without notifying you or receiving your consent.

A Few Reasons Why This Carrie Underwood/"Something in the Water" Lawsuit Seems Super Fishy

Ron McNeil and Georgia Lyons recently filed a lawsuit in federal court stating that, Carrie Underwood and her co-writers on "Something in the Water" stole the song from them.

Their lawsuit reads, "the hook on the infringing work, as released on the album, is structurally and lyrically identical, and substantially similar melodically to plaintiffs' composition of the same title."

The duo is also claiming they sent the song to Underwood, but "never heard back" and then she released the song.

Ummm...okay, now something's fishy.

Carrie Underwood probably gets sent a song every 2 hours from songwriters. Lots of those songwriters probably "don't hear back." She's Carrie Underwood.

You know what else is fishy? Ol' Ron McNeil's website. I know I work for the Internet and might have more knowledge on websites than a lot of people, but this is not the website of a hit songwriter.

Ballerini wrote the song in her hometown bedroom to make sure she should could still do it on her own, ""When you write a song by yourself, there's a different level of vulnerability that you can tap into...I started relying on other people's creativity so much that I stopped believing in myself enough to write a song by myself," she told Time.

You've changed, and you've evolved and you don't fit somewhere anymore."

Reba McEntire and Carrie Underwood Go Head To Head on "Does He Love You" During 40th Opry Debut Celebration

Forty years ago, Reba McEntire made her debut on the Grand Ole Opry. Last night she celebrated that milestone with surprise appearances from Dolly Parton and Carrie Underwood. Her good friend Vince Gill hosted the show.

McEntire, who made her debut on September 17, 1977, recalled the momentous occasion saying, "It was a lot of fun. It was nerve-wracking; it was scary. This means the world to me. It's been a wonderful 40 years. I couldn't have done it without you, and I wouldn't have wanted to!"

Underwood surprised the crowd by performing her hits "Wasted," "Church Bells" and "I Told You So." She then took the stage for a duet with McEntire on a stunning rendition of the 1993 hit "Does He Love You." "It's always an honor to be on this stage, especially tonight. You are an inspiration to us all," Underwood told the legendary singer.

When Parton took the stage, she recalled McEntire's special night forty years ago. It just so happened that the "9to5" singer was making a surprise appearance on the Opry that same night. As a result, McEntire had to cut her performance down to one song.

"I just wanted to give it back to you tonight ... and say hello and congratulations and how much I love you," Parton said to McEntire. This time around, Parton was on hand to present a three-tier cake to McEntire in celebration of her big night.

As Gill hosted the show, he shared some kind words for his good buddy saying, "She's an old, sweet, dear friend of mine, "There's not many people you can guarantee they've got your back. And this is one of my best friends in the world."

Congratulations Reba. Here's to 40 more!

Eric Church Releases Second Set of 30 Live Recordings With More To Come

Eric Church's 61 Days in Church project is in full swing.

The singer has recorded over 200 live performances from his 61-date Holdin' My Own Tour and he's releasing the recordings to the public. Church initially released 30 live recordings from various stops across North America on Sept. 1 and has now released 30 more songs. That's a lot of songs, with more to come.

The songs performed by Church consist of catalogue cuts and singles as well as cover songs inspired by each tour stop.

"I had so much fun learning songs that were unique to whatever city we found ourselves in," Church said. "I learned a lot about each place, and it was special to see the crowd react to the songs that were only for them. I'm glad we recorded it and can relive it forever."

The North Carolina native partnered with Apple Music to release over 100 live recordings. The songs will be available on Apple for a two-week period and will then become available on all streaming services. Physical releases of all the songs will be made available soon.

Kenny Chesney Spreads Awareness With Love for Love City—"People Really Aren't Seeing How Devastating These Hurricanes Have Been"

Kenny Chesney has been living in the U.S. Virgin Islands for over two decades, so when Hurricane Irma and subsequently Hurricane Maria came through and devastated most of the islands, Chesney needed to do something. He wanted to help the many friends he made over the years on both the U.S. and British Virgin Islands

That's why Chesney created Love for Love City Foundation. The foundation was started to identify pressing local needs, create opportunities for companies to donate supplies, food, physical goods or transport and people to contribute to the ongoing rebuilding of the islands.

"Getting supplies in is hard. Finding places for workers to stay is even harder now that Hurricane Maria has done so much damage to St. Croix," Chesney says. "Because it's so hard to get even the basic supplies in, let alone the news media, people really aren't seeing how devastating these hurricanes have been."

Chesney has already been doing everything he can to help out, including using his private plane to transport supplies such as, food, water, medical supplies, generators, tools, clothes, tarps and camping equipment, to those in need. The plane was also useful when Chesney transported two teen boys, who were stranded, over to the states to be with their mother.

"With all the crisis across the country, it's so easy to feel overwhelmed, or to respond to the first person who reaches out. In St. John and the other surrounding islands, there is so much more to the needs than just materials," Chesney adds. "We have to get the equipment necessary there… We need to figure out how to shelter workers rebuilding the community… We have to understand, too, that entire communities have been wiped out. Right now, making sure the people in the U.S. and British Virgin Islands aren't forgotten in all the other equally troubling stories is critical."

The "Living in Fast Forward" singer wants everyone to know that Love for Love City is the sole charity that he is affiliated with. Other charities claiming to be associated with or working with the singer are not to be trusted.
